The following general terms and conditions apply to all events and trips booked through the transport company Alexander Morstadt Partybus & Event Shuttle Service, also known as Partybus Mieten, or arranged through one of our partners.
Conclusion of the contract
The booking must be made by email or in writing by post. Upon receipt, the client will receive a booking confirmation from Partybus Rent.
Services
The contractual services are based on the written offer.
Resignation of the client
The client can withdraw from the contract at any time. The withdrawal should/must be declared in writing. Partybus Mieten is entitled to claim a cancellation fee as a cancellation fee, which is calculated as a percentage of the booking price as follows: If you cancel up to the fourth working day before the start of the booking, 50% of the total price. Less than four working days before the start of the booking, in case of no-show and cancellation after the start 100% of the total price. §309 BGB 5b remains unaffected.
Disruption by the client
All instructions from the driver or our staff must be followed. Partybus Mieten can terminate the contract without notice if the client continues to cause significant disruption despite a warning, so that his participation is no longer reasonable. In this case, Partybus Mieten are entitled to the full price. Claims for damages otherwise remain unaffected.
Minimum sales and package deals
If an agreed minimum turnover is not reached, this minimum turnover will be charged in full. If the services offered in the package deal are not all required, they will be still invoiced in full.
Invoice objections
Objections to the invoice issued by Partybus Mieten must be reported to Partybus Mieten in writing within four weeks of the invoice date. Subsequent objections will not be considered.
Expectations
Claims due to insufficient services, subsequent impossibility and violation of ancillary obligations must be asserted by the person making the booking within four weeks of the contractually agreed end of the event to Partybus Mieten.
Breakdown of vehicles
Our vehicles are special vehicles. Unfortunately, short-term failures, defects or accidents cannot be ruled out. In the event of a failure, Partybus Mieten will endeavor to find an adequate replacement, but this cannot be guaranteed in principle.
Payment
After booking, the total price can be transferred to the account specified in the booking confirmation. If not transferred in advance, the sum is to be paid at the beginning of the event. If the amount is not paid on time, Partybus Mieten is entitled to withdraw from the contract. In this case, Partybus Mieten will charge the above-mentioned withdrawal costs (cancellation fees).
Vehicle dirt and damage
The cleaning of exceptionally heavily soiled vehicles will be charged to the client. Any damage caused by the client or third parties to and in the vehicles is entirely at the expense of the client.
Place of jurisdiction
Partybus Mieten can only be sued at its registered office. The domicile of the customer is decisive for lawsuits by Partybus Mieten against the customer, unless the lawsuit is directed against registered traders or persons who have moved their domicile or usual place of residence abroad after the conclusion of the contract or whose domicile or usual place of residence is not known. In these cases, the seat of Partybus Mieten is decisive.
Other Terms and Agreements
These conditions apply unless individual agreements are made in writing. The invalidity of individual provisions does not result in the invalidity of the entire contract. The application of German law is agreed.
